Please read these Terms of Service carefully before using MakersPage. By creating an account or using our platform, you agree to be bound by these terms. If you do not agree, do not use the platform.

1. About MakersPage

MakersPage ("we," "us," "our," or "the Platform") is a marketplace and community platform operated from Pennsylvania, United States, designed for digital product sellers and their customers. MakersPage enables sellers ("Makers") to create pages, sell digital products, offer memberships, post updates, and connect with their audience ("Fans" or "Users").

These Terms of Service ("Terms") govern your access to and use of MakersPage, including our website at makerspage.com, and all related services. By using MakersPage, you confirm that you are at least 18 years old and capable of entering into a binding agreement.

2. Account Registration

2.1 Creating an Account. To use MakersPage, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

2.2 Account Types. MakersPage offers two account types: Fan accounts and Maker accounts. Fan accounts are the default. Users may upgrade to a Maker account at any time to access seller features. You may not create multiple accounts or transfer your account to another person.

2.3 Account Security. You must notify us immediately at support@makerspage.com if you suspect any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to maintain account security.

2.4 Age Requirement. You must be at least 18 years of age to create an account. By creating an account, you represent and warrant that you meet this requirement.

3. Maker Eligibility & Geographic Availability

MakersPage Maker accounts (seller accounts) are currently available to individuals and businesses located in the following countries only:

  • United States
  • United Kingdom
  • Australia
  • European Union member states

By registering as a Maker, you confirm that you are located in one of the above countries and that you are legally permitted to sell digital products and receive payments in your jurisdiction. We have made reasonable efforts to ensure our platform supports tax compliance requirements (Sales Tax, VAT, GST) for these regions. It remains your sole responsibility to comply with all applicable tax, trading, and financial laws in your country.

Buyers and fans may access and purchase from MakersPage from any country where doing so is not prohibited by local law. MakersPage makes no representation that content or products available on the platform are appropriate or legally available in all locations.

We reserve the right to expand or restrict geographic availability at any time. If your country is not currently listed above and you attempt to register as a Maker, your account may be suspended or terminated.

4. Maker Accounts & Selling

3.1 Becoming a Maker. Any registered user may upgrade to a Maker account to sell digital products and offer memberships. By becoming a Maker, you represent that you have the legal right to sell the content you list on the platform.

3.2 Platform Fees. MakersPage does not currently charge a platform fee or commission on sales. You retain 100% of your sales revenue. Payment processors (Stripe, PayPal) charge their own transaction fees which are separate from and not controlled by MakersPage. We reserve the right to introduce platform fees in the future with reasonable advance notice to Makers.

3.3 Payments. All payments are processed directly through your connected Stripe or PayPal account. MakersPage does not hold, process, or have access to your funds. You are solely responsible for setting up and maintaining your payment accounts and for complying with their terms of service.

3.4 Taxes. You are solely responsible for determining and fulfilling your tax obligations arising from your use of the platform, including income taxes, sales taxes, and VAT where applicable. MakersPage does not provide tax advice.

3.5 Refunds. Refund policies are set by individual Makers. MakersPage does not process refunds and is not responsible for resolving payment disputes between Makers and buyers. We encourage Makers to have a clear refund policy on their pages.

5. Prohibited Content & Conduct

You may not use MakersPage to:

  • Sell, distribute, or promote illegal products or services
  • Upload or sell content that infringes on intellectual property rights of others
  • Upload malicious files, viruses, or harmful code of any kind
  • Harass, threaten, or harm other users
  • Create fake accounts or impersonate others
  • Use automated bots or scrapers without written permission
  • Engage in fraudulent activity including fake purchases or reviews
  • Post spam or unsolicited promotional content
  • Sell adult content, explicit material, or content inappropriate for a general audience
  • Circumvent or attempt to circumvent any security features of the platform
  • Use the platform for any purpose that violates applicable local, state, national, or international law

We reserve the right to remove any content and suspend or terminate any account that violates these prohibitions, at our sole discretion and without prior notice.

6. Intellectual Property

5.1 Your Content. You retain all ownership rights to the content you upload to MakersPage, including product files, images, posts, and profile information ("Your Content"). By uploading content, you grant MakersPage a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute Your Content solely for the purpose of operating and promoting the platform.

5.2 Your Responsibility. You represent and warrant that you own or have the necessary rights to all content you upload, that your content does not infringe any third-party intellectual property rights, and that you have the right to grant the license described above.

5.3 MakersPage Intellectual Property. The MakersPage name, logo, website design, and all platform code are owned by MakersPage and protected by applicable intellectual property laws. You may not use, copy, or reproduce any MakersPage intellectual property without our written permission.

5.4 Copyright Infringement. If you believe content on MakersPage infringes your copyright, please contact us at support@makerspage.com with a description of the allegedly infringing material and your contact information. We will investigate and respond promptly.

7. Digital Products & Downloads

6.1 Digital Nature of Products. All products sold through MakersPage are digital files. Due to the nature of digital products, all sales are generally final once a file has been downloaded. Makers may set their own refund policies at their discretion.

6.2 Download Links. Where MakersPage provides hosted download links, these links are valid for 48 hours after purchase unless otherwise specified. It is your responsibility to download and save your files within this window.

6.3 File Accuracy. Makers are solely responsible for the accuracy, quality, and completeness of their product descriptions and files. MakersPage does not verify, endorse, or guarantee any digital products sold on the platform.

6.4 Personal Use. Unless explicitly stated otherwise by the Maker in their product listing, digital products purchased on MakersPage are licensed for personal use only and may not be resold, redistributed, or used for commercial production runs without the Maker's written permission.

8. Memberships & Subscriptions

7.1 Recurring Billing. Memberships are subscription products that renew automatically at the billing interval selected (monthly or yearly) until cancelled. By subscribing, you authorize the Maker's connected payment processor to charge your card on a recurring basis.

7.2 Cancellation. You may cancel a membership at any time from your account settings. Cancellation takes effect at the end of the current billing period. You retain access to member benefits until the period you paid for expires.

7.3 Maker Responsibility. Makers are responsible for delivering the perks and benefits described in their membership tiers. MakersPage is not responsible for ensuring Makers fulfill their membership obligations.

7.4 Changes to Memberships. Makers may change or discontinue membership tiers. In the event a membership tier is discontinued, subscribers will be notified and no further charges will be made after the current billing period.

9. Disclaimers & Limitation of Liability

8.1 Platform Provided "As Is." MakersPage is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2 No Guarantee of Earnings. MakersPage makes no guarantee of income or revenue for Makers. Your results depend entirely on your own efforts, products, and audience.

8.3 Third-Party Services. MakersPage integrates with third-party services including Stripe, PayPal, Google Drive, and Resend. We are not responsible for the availability, accuracy, or reliability of these services.

8.4 Limitation of Liability. To the maximum extent permitted by law, MakersPage shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the platform, even if advised of the possibility of such damages. Our total liability to you for any claim arising out of these Terms shall not exceed $100 USD.

10. Indemnification

You agree to indemnify, defend, and hold harmless MakersPage and its operators from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or in any way connected with your access to or use of the platform, your violation of these Terms, your violation of any third-party rights, or any content you post or sell on the platform.

11. Termination

10.1 By You. You may close your account at any time by contacting us at support@makerspage.com. Closing your account does not entitle you to any refund of fees paid to Makers.

10.2 By Us. We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any reason we deem necessary to protect the platform or its users.

10.3 Effect of Termination. Upon termination, your right to use the platform ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, indemnification, and limitation of liability.

12. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of MakersPage shall be resolved exclusively in the state or federal courts located in Pennsylvania. You consent to the personal jurisdiction of such courts.

Before pursuing legal action, we encourage you to contact us at support@makerspage.com so we can attempt to resolve the issue informally.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For significant changes, we will notify users via email or a prominent notice on the platform. Your continued use of MakersPage after changes take effect constitutes your acceptance of the revised Terms.
